Let’s Fix The De Facto Kratom Ban

Dear Councilmember,

I am writing to express concern about the proposed ordinance regulating intoxicating substances currently before the Committee on Commerce & Economic Development.

While I support responsible regulation and consumer safety standards, I am concerned that the bill’s FDA drug approval requirement would effectively prohibit the sale of natural kratom leaf products in Philadelphia.

Natural kratom is a botanical product, not a pharmaceutical drug subject to FDA approval under Section 505 of the Federal Food, Drug, and Cosmetic Act.

It is important that policymakers distinguish between natural kratom leaf products used responsibly by adults and dangerous, concentrated synthetic derivatives that raise legitimate safety concerns.

I respectfully urge the City Council to revise this legislation so it focuses on targeted regulation, product safety, and consumer protections rather than creating a de facto ban on natural kratom leaf.
